Assam -based Indian Police Service (IPS) officer, Gaurav Upadhyay, has been accused of molesting a minor. A special court in Assam recently ordered the allegations against Upadhyay in the six -year -old case under the Protection of IPC children (POCSO) Act and other sections of IPC.

‘Two incidents of sexual attack’
In its order, the special court said that there were “two incidents of sexual assault on the survivor” by the accused, who was the Superintendent of Police of Karbi Anglong, Assam at the time of the incident.
The court quoted the news agency PTI as saying, “The first attack took place in the SP bungalow in Difu (city in Assam). The second attack took place in the hotel room, where the survivor was living with his mother and brother.”
The judge said that as the Upadhyay was Karbi Anglong SP at the time of the incident, it occurred as a police officer within the limits of jurisdiction and control, which attracts Section 9 and (L) of the POCSO Act and was punishable under Section 10 of the same law.
‘Force to kiss, touched its private parts’
The court order reportedly stated that “the use of criminal force” to kiss the victim “and” physical contact and advance “by touching his private parts – as stated in his statement especially by the minor – leads to charges under Section 354 and 354A of the Indian Penal Code (IPC).
Special judge heard the verdict,
Section 10 of the POCSO Act relates to an increased sexual assault sentence, while Section 354 and 354A of the IPC are for an attack on a woman or criminal forces related to criminal forces, which is with the intention of annoying her humility or sexual harassment.
